Privacy Notice for processing as an Approved Medical Examiner of Divers (AMED)

Purpose

As part of the process for providing medicals for fitness to dive as an AMED for the Health and Safety Executive (HSE), AMEDs act as a data controller in their own right.

When AMEDs update the HSE database about the diver’s fitness and certification to dive, AMEDs act as a data processor and are subject to a strict data protection contract with HSE in order to support compliance under UK Data Protection legislation.

This work supports HSE as the regulator for Health and Safety in the UK and the work they do regulating diving certifications under the Diving at Work Regulations (DWR), when performing medical examinations necessary for diver certification.  

Lawful basis for processing

 

Under the UK General Data Protection Regulation (UK GDPR) and the UK Data Protection Act 2018, the lawful bases we rely on for processing this information are:

 

For the information you provide for your application for fitness to Dive and Diver certification, we will process your personal information under UK GDPR Article 6(1)

·         (c) processing is necessary for compliance with a legal obligation to which the controller is subject; under

For medical data that may be processed as part of the medical for fitness to dive AMEDs will process your health data under Article 9 (2) :UK GDPR

AMED will be relying on (h) Health or social care (with a basis in law)

Where (b), (h), (i) or (j) are relied on, the following condition under Part 1 of Schedule 1 of the DPA18 applies:

AMED will be relying on Condition 2 – Health or social care purposes (occupational medicine)
